Court Rejects Bail for Pulwama Attack Accused Insha Jan

What Happened

A special NIA court has rejected the bail plea of Insha Jan, an accused in the 2019 Pulwama suicide attack case. The judge said the material on record was enough to treat the allegations as prima facie true under the UAPA, the anti-terror law that makes bail harder in certain cases.

Legal Impact

The order leans heavily on Section 43-D(5) of the UAPA, which blocks bail when the court finds reasonable grounds to believe the charges are prima facie true. The court also rejected delay in trial and Jan’s health problems as enough to override that bar, while directing jail authorities to provide medical care.

Limits

The defence argued that Jan has been in custody for more than six years, only 49 of 240 prosecution witnesses had been examined, and the slow pace made continued detention unjustified.

The NIA said she was a well-connected terror associate who helped provide shelter and logistics to Jaish-e-Mohammed operatives, and warned that release could let her influence witnesses.
